Terms of Service

Treble is a product and service offered by digifi LLC, a Limited Liability Company (the "Company"), through its website located at https://treble.io (the "Site") and associated applications, software, and services (collectively, the "Services"). Your access to and use of the Services is subject to the terms and conditions set forth below (these "Terms"), as they may be amended from time to time by the Company. Please also review our Privacy Policy to understand how we collect, use, and protect your personal information.

By accessing, registering for, or using the Services in any capacity, including through the creation of an account, submission of information, or execution of an online order or subscription, you agree to be bound by these Terms. If you do not accept all of the Terms, you may not use or access the Services.

2. Description of Services

The Treble platform provides tools and features designed to help users manage their email workflows, surface relevant tasks, and streamline productivity using artificial intelligence. The Services may include email parsing, summarization, calendar integration, task suggestion, and related automation features.

3. Registration and Eligibility

To access certain features of the Services, you must register for an account. You agree to provide and maintain accurate, current, and complete information. You are solely responsible for safeguarding your credentials. You must notify the Company immediately of any unauthorized use of your account.

The Services are not intended for individuals under the age of 13. If you are under 18 years old, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

4. Use of Third-Party Services and APIs

If you connect your Google account or use features that rely on Gmail data, the Company's use of your data will comply with the Google API Services User Data Policy, including its Limited Use requirements.

5. AI-Generated Output and Disclaimers

The Services may generate content using machine learning models provided by third parties, including OpenAI. You are solely responsible for verifying the accuracy of any generated text, insights, or suggestions. Due to the probabilistic nature of AI, results may be imprecise, inaccurate, or offensive.

All input you provide to the AI tools ("Input") and all responses ("Output") are considered User Content under these Terms. The Company makes no warranties regarding Output, including factual accuracy or fitness for a particular purpose.

6. Subscription Terms

Access to certain features of the Services may require payment of fees. You agree to pay all applicable fees in accordance with your selected subscription plan. Subscriptions will renew automatically unless canceled before the end of the billing period. You authorize the Company and its third-party payment processor to charge your payment method on a recurring basis. The Company uses Stripe for secure payment processing. By using our services, you agree to comply with Stripe's terms of service and privacy policy.

7. User Conduct

You agree not to:

• Violate applicable laws or regulations;
• Transmit harmful code, spam, or abuse the Services;
• Attempt to reverse engineer, hack, or disrupt the platform;
• Use the Services in a manner that infringes or misappropriates the rights of others.

8. Intellectual Property

The Services, including all software, code, logos, and content (excluding User Content), are and shall remain the property of the Company or its licensors. Treble and associated marks are trademarks of the Company. You may not use these marks without prior written permission.

9. User Content

You retain ownership of any content, data, or files you upload or generate using the Services ("User Content"). You grant the Company a limited, non-exclusive license to use User Content solely for the purpose of providing and improving the Services.

10. Confidentiality

Each party agrees to protect the other party's confidential information using reasonable care and not disclose it to third parties, except as required by law or to fulfill obligations under these Terms. Confidentiality obligations survive termination.

11. Indemnification

You agree to indemnify and hold harmless the Company from any claims, losses, or damages arising out of your use of the Services, your User Content, or your breach of these Terms.

12. Warranty Disclaimer

The Services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied. The Company disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. You use the Services at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages. The Company's total liability shall not exceed the amount you have paid for the Services in the twelve (12) months prior to the claim or one hundred dollars ($100), whichever is greater.

14. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Services shall be resolved by final and binding arbitration under the rules of the American Arbitration Association. The arbitration shall take place in a reasonably convenient location to both parties. You waive the right to a jury trial and to participate in class actions.

15. Termination

You may terminate your account at any time by following the instructions in your user settings. The Company may terminate your access to the Services if you breach these Terms or if required by law. Upon termination, your license to use the Services ends, but sections that by nature survive will remain in effect.

16. General Provisions

These Terms constitute the entire agreement between you and the Company. They are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. If any provision is found unenforceable, the remainder of the Terms will remain in full force.
